2025 Town of Jackson Parklet Program

The Town’s Parklet Program supports businesses to host parklets within the public right-of-way encouraging outdoor dining and promoting a vibrant, active streetscape. Related standards and regulations ensure that public space utilized for parklets promotes health, safety, and welfare.  


Application Submission
Applications must be submitted and approved before parklets are set-up. Only complete applications will be processed. 


Inspections
In addition to this permit, applicants are responsible for acquiring necessary inspections, reviews, authorizations, permits, and approvals from the Town and County.


Permit Fee
Permit fees are $3,500/year. Fees must be paid in full with applications and can be for 1, 2, or 3 years. Bonds, as determined by the Town, may also be required. 


Timing & Space
Parklets are permitted to operate between April 30 and October 30 annually and may occupy a maximum of 3 contiguous parking spaces. 


Per TOJ Ordinance 10.11.110, The Town may deny a permit application, require modification to an existing permitted parklet, or revoke or suspend an existing permit for any reason.

Applicant must acknowledge they will not store, setup, display, or sell any time/temperature-controlled food safety items in the parklet, except for takeout items. Food preparation may not occur within the parklet. Do you acknowledge you have read, understand, and abide by the time/ temperature-controlled statement?

Signs must be located inside the parklet perimeter and may not exceed 8 square feet or appear on adjacent sidewalk or boardwalk. Banners are not permitted.

Parklet Perimeter Types (Please check all that apply)

Will the parklet have any sort of overhead coverage? (Shade sail, umbrellas, etc.). A roof or hard material overhead is not permitted.

Site Plans should be images with legends clearly delineating all elements of your parklet perimeter and items within it. A defined perimeter for each parklet is required. Include accurate dimensions, tables, chairs, benches, bike racks, any proposed lighting, umbrellas or other shades, planters, proposed signage, portable heaters, location of fire hydrants, manholes, utility poles, utility boxes, and anything else in and around your parklet. Please also consider the following:

  • Parklets may not interfere with existing curb uses including but not limited to designated fire lanes, loading zones, bus stops, taxi zones, or handicap parking spaces.  

  • Parklets may not cover manholes or fire hydrants or block utility boxes, which must remain accessible in case of an emergency.  

  • Parklets may not interfere with pedestrian traffic.  

  • Parklets must ensure patrons are safely buffered from traffic. Physical barriers are required alongside traffic lanes and adjacent to active parking spaces.  

  • Solid walls, roofs, or ceilings are not permitted.

Upload Insurance

Applicants must provide the Town with a current certificate of insurance evidencing the following required insurance coverage and terms prior to permit issuance. Applicants shall, at their own expense, procure and maintain policies of commercial general liability insurance with a combined single limit amount of at least one million dollars ($1M) covering parklet operations in the public ROW. Insurance must: Be through an insurer authorized in Wyoming; Name the Town of Jackson and its officers and employees as additional insureds and ensure they have non-contributory coverage; and contain a provision for thirty days’ prior written notice of cancellation to the Town

Parklet Rules, Inspections, and Conditions

Rules

  • Parklets may not be set-up before the Town issues a permit and all related fees are paid.  

  • Parklets may not operate as stand-alone businesses.  

  • Parklets may not emit amplified sound. 

  • Parklets may not have solid walls, roofs, or ceilings.  

  • Parklet permits authorize operation within areas depicted in Site Plans submitted with applications only: parklets may not intrude into immediately adjoining spaces or areas. 

  • Parklets may not obstruct, interfere with, or hinder the use of sidewalks, roads, or restricted areas, including ADA spaces, “red curb” areas, bus parking zones, or fire lanes. 

  • Smoking, including vape products, shall not be permitted within five feet of any parklet.  

  • Parklets can only be restricted for use by patrons of a businesses during operating hours and otherwise must be open to the general public with signs stating open hours. 

  • Parklet permit fees are non-refundable and not pro-rated. Denied applications may, but are not guaranteed to, receive refunds. 

  • Parklet permittees must have trash and recycling cans, collect and remove all trash and recyclables generated by parklets, prevent overflowing cans, and keep parklets and surrounding areas trash-free. Parklets may not use Town trashcans or benches. 

  • Parklet permitees may not allow patrons to sit on perimeter elements like barriers or planter boxes 

  • Parklet and parklet areas must be kept clean and aesthetically pleasing to patrons and general public. 

Inspections and Conditions

  • Parklets shall be inspected by Public Works staff prior to receipt of parklet permit or start of operations. 

  • Parklet permittees shall meet all Fire Department regulations and standards, including electrical codes. 

  • Parklet permittees shall meet all Building Department regulations and standards.  

  • Parklet permittees shall obtain all necessary food service permits from the Health Department.  

  • Parklet permittees shall comply with all applicable alcohol dispensing laws and regulations and may not allow customers to leave the parklet perimeter with open alcohol containers. 

  • Parklet permittees shall provide training records for their staff serving alcohol. 

  • Parklets shall not exceed maximum occupancy while in use by the applicant. 

  • Parklet permittees must, at their own expense, remove all property, furnishings, and equipment from the public right-of-way, returning it to its original condition on/before October 30.  

  • Bonds are required to restore the right-of-way to its original condition. The Town determines the bond amount, which may be $0 if there is not significant construction. Paid bonds are released when permits expire and the space is restored to the Town’s satisfaction minus necessary restoration costs.  

  • Parklet permittees shall display approved parklet signs provided by the Town of Jackson. 

  • Failure to comply with any of the above conditions may result in revocation of permits. Written warnings will be issued following violations. Parklet permits may be revoked after three warnings.  

  • The Town maintains the right to inspect parklets at any time. 

(Ord. 1344 § 1, 2023). All town ordinances apply to parklets. 

Indemnification and Waiver

This Parklet permit is subject to all rules and conditions listed in this application. This permit may be revoked or suspended by the Town of Jackson pursuant to the Ordinance. This permit and application may be modified by the Town at any time.  
 
By signing this Application, the Applicant affirms the information submitted in support of the Application is true and correct to the best of the Applicant’s knowledge and understands the information provided may be investigated for accuracy by the Town of Jackson.

In consideration for the Town of Jackson's issuance of the permit for the permitted activity, the Applicant agrees to indemnify, defend and hold harmless the Town of Jackson and all of its elected officials officers, agents, representatives and employees against any and all suits, including attorney's fees, causes of action or claims for injuries, damages, costs and expenses to persons or property, whether public or private, that may arise out of, or any activity related to operating a Parklet, or any act, negligence, omission or misconduct of the Applicant or its officers, members, agents, representatives, contractors, subcontractors, invitees or employees. Notwithstanding the foregoing, the above shall not be construed to and shall not impose an obligation to indemnify and save harmless the Town or any of its elected officials, officers, agents or employees from any claim, loss, damage, liability or expense arising from any gross negligence by the same. 
 
The provisions of this Indemnification and Waiver are solely for the benefit of the parties hereto and not intended to create or grant any rights, contractual or otherwise, to any other person or entity, and shall survive termination or expiration of this Indemnification and Waiver. 
 
By signing the Indemnification and Waiver above, the Applicant certifies that the information provided to the Town of Jackson is correct; the Applicant has read and understands the information contained in this Indemnification and Waiver; and the Applicant agrees to operate a Parklet in compliance with all applicable local codes and ordinances, state, and federal laws.
